1. General Provisions

These Terms and Conditions (“Terms”) apply to all bookings and services provided by Nagi Kotsu, including but not limited to chartered vehicle hire, airport transfers, and chauffeur-driven transport within Japan.
By confirming a booking with Nagi Kotsu, the client (“Client” or “Passenger”) agrees to be bound by these Terms.
Nagi Kotsu reserves the right to amend or update these Terms at any time without prior notice. The latest version shall apply to all bookings confirmed after the update.

2. Service Scope and Definitions

Private Hire / Charter refers to vehicle hire with driver for exclusive use by the client during the contracted period.
Airport Transfer refers to pre-arranged transportation to or from designated airports (Haneda, Narita, Kansai, etc.) under fixed conditions.
Garage-to-Garage Basis means time and distance calculations are made from the vehicle’s departure from and return to Nagi Kotsu’s garage, not from the client’s boarding time.
Operating Hours are from 05:00 to 22:00 Japan Standard Time. Late-night usage between 22:00 and 05:00 incurs a surcharge.

3. Bookings and Confirmations

Bookings must be made in advance through Nagi Kotsu’s official booking form, email, or designated platform.
A booking is only confirmed once written confirmation and payment (or authorized credit guarantee) are received.
Any modification to the pick-up time, route, or destination must be requested at least 24 hours prior to service commencement. Changes after that time are subject to approval and may incur additional charges.
Clients must ensure all information provided (dates, addresses, passenger count, luggage details) is accurate. Nagi Kotsu shall not be liable for delays or costs arising from incorrect information.

4. Pricing and Payment Terms

All prices are quoted in Japanese Yen (JPY) and are subject to 10% consumption tax.
Unless otherwise stated, highway tolls, parking fees, and entrance fees are not included and will be billed separately.
Prices are calculated on a garage-to-garage basis, including up to 15 minutes of standby before the scheduled pick-up time.
Late-night usage between 22:00 and 05:00 is charged at 1.25 times the standard rate.
All vehicles are strictly non-smoking. A cleaning fee or damage charge will apply in case of smoking or damage to the interior.
Payment must be made in advance via bank transfer, credit card, or approved invoicing terms unless otherwise agreed in writing.

5. Airport Transfers

The client must specify the pick-up time in advance. Changes after 18:00 on the day before the service cannot be accepted.
To accommodate potential delays in customs, immigration, or baggage handling, Nagi Kotsu provides a grace period of approximately one hour from the flight’s actual landing time.
After this grace period, extension fees apply every 30 minutes.
All airport transfer flat rates include highway tolls.
The price is calculated based on the time the vehicle departs and returns to the garage, not by the time the passenger remains on board.

6. Cancellations and Amendments

Cancellation requests must be submitted in writing.
Unless otherwise stated in the quotation or contract, the following charges apply:
• 48 hours or more before service: No charge
• 24–47 hours before service: 50% of total fee
• Less than 24 hours / No show: 100% of total fee
Delayed flights, weather disruptions, or acts of nature may be subject to review; however, costs already incurred (e.g., driver dispatch, tolls) remain chargeable.
Nagi Kotsu reserves the right to cancel or modify services in the event of vehicle breakdown, natural disaster, or unforeseen operational circumstances. In such cases, refunds or suitable alternatives will be offered at Nagi Kotsu’s discretion.

7. Conduct and Passenger Responsibilities

Passengers must behave respectfully toward the driver and vehicle.
Food and drinks are generally not permitted unless approved in advance.
The carrying of hazardous, illegal, or flammable materials is strictly prohibited.
The driver reserves the right to refuse boarding to any passenger deemed intoxicated, aggressive, or endangering safety.
Any damage to the vehicle caused by passengers will be charged at cost, including downtime loss and cleaning fees.

8. Liability and Insurance

Nagi Kotsu maintains the legally required automobile insurance and liability coverage in accordance with Japanese transport law.
Nagi Kotsu shall not be liable for indirect or consequential losses such as missed flights, hotel penalties, or schedule changes resulting from traffic congestion, weather conditions, or force majeure.
Clients are strongly advised to obtain personal travel insurance.

9. Delays, Traffic, and Force Majeure

Japan’s road network and traffic conditions are beyond the control of Nagi Kotsu. The company cannot guarantee arrival times in the event of traffic accidents, road closures, or natural disasters.
In such cases, Nagi Kotsu will make every reasonable effort to minimize disruption and communicate promptly with the client.
No refunds or compensation shall be provided for delays caused by circumstances beyond the company’s reasonable control.

10. Personal Data Protection

Nagi Kotsu complies with the Act on the Protection of Personal Information (APPI) of Japan.
Client data will be used solely for the purpose of managing bookings, communication, and legal compliance.
Data may be shared with affiliated drivers or subcontracted transport companies strictly for operational purposes.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.
